Terms of Service

1. Who we are

BuildTrack is provided by BuildTrack, Chingola, Zambia (support@buildtrackzm.com, +260 979 709 820). References to “we” mean BuildTrack; “you” means the company creating a tenant and its authorised users.

2. Acceptance & eligibility

You must be 18+ and have authority to bind your company. Creating a workspace, inviting users or paying via Lipila confirms acceptance. If you do not agree, do not use the service.

3. Accounts & workspaces

• One tenant = one company_id. Data is isolated per company (tenant-api.ts: requirePermission).
• You are responsible for user roles (Owner/Admin/PM etc.) and for keeping credentials and 2FA secure.
• One person, one account. Sharing passwords violates the DPA.

4. Plans, trials & billing

• Plans: Starter (K750/mo, 14-day free trial, 5 users/3 projects), Professional (K2,500, 25/15), Business (K5,900, 100/unlimited), Enterprise custom — as listed on /pricing.
• Billing: Monthly or annual via Lipila. Annual averages ~K625 (Starter) etc. No card stored by us.
• Trial: Full Starter features for 14 days; convert to paid before expiry or data enters read-only after 90-day grace.
• Switching: Up/down grade immediate; prorated credit applied to next invoice (`changePlan` `tenant-api.ts:2257`).
• Cancellation: Active until period end, then read-only. Refunds per Zambia Consumer Protection Act — pro-rata if service was unavailable.

5. Acceptable use

You agree not to: upload illegal, infringing or malware content; attempt to access another tenant; overload the service; scrape or reverse-engineer isolation; use for non-construction spam. We may suspend for breach after notice.

6. Intellectual property

We own BuildTrack software, logo (yellow helmet), and hedgehog marks. You own your input data and retain IP in BOQs, photos and reports you generate. You grant us a licence to host/process it to provide the service and backups.

7. Data & privacy

Tenant isolation, encryption, audit logs, and DPA rights are in the Privacy Policy. By using AI features you consent to OpenRouter/OpenAI processing of document extracts per their terms.

8. AI features

KUU AI and cost/risk analysis use OpenRouter (`gpt-4o-mini`) with your live project context. Outputs are advisory — verify quantities and costs before ordering. No guarantee of accuracy; you remain liable for decisions.

9. Uptime & support

We target 99.5% monthly availability (excl. planned maintenance). Support via in-app Help & `/support` — Starter: community, Business: 24h SLA, Enterprise: dedicated CSM. Check /admin for status.

10. Limitation of liability

To the extent permitted by Zambian law, our aggregate liability is limited to 12 months of fees paid. We are not liable for indirect loss, loss of profit, or site costs arising from reliance on AI/forecasts.

11. Indemnity

You indemnify us against claims from your users, site incidents or breach of acceptable use.

12. Term & termination

Term until cancelled. We may suspend for non-payment (past-due grace 7 days), breach, or legal requirement. On termination you have 90 days to export via Reports → Excel/PDF.

13. Changes

Material changes notified 30 days by email/in-app. Continued use = acceptance. Non-material clarifications take effect on posting.

14. Governing law

These terms are governed by the laws of Zambia. Disputes first via negotiation/mediation in Lusaka, then courts of Zambia.
